The easiest, cost effective way of registering a church as a Non-Profitable is via a
Voluntary Association.
HOW IT WORKS: The legal basis for a Voluntary Association is an agreement between 3 or more persons to promote a public purpose other than making a profit. It is however much better from a governance point of view to have an agreement in writing. This agreement is also called the Constitution. The Voluntary Association comes into existence once the Constitution has been adopted by its first members (Executive Board in our case). This normally takes place at the first meeting of the church or organisation. The Voluntary Asssociation is not required to register at any public office in order to exist as a legal entity. It is a good idea to include a schedule at the end of the Constitution where members (Executive Board) can sign as proof of the adoption of the Constitution. Once the members have adopted the Constitution, it becomes a binding legal agreement. It is the same as for example signing a lease agreement.
REGISTERING AS A NONPROFITABLE ORGANISATION: Once the Voluntary Asssociation has been founded, registration as a NPO must take place immediately.
